Agreement to Terms

By accessing or using JobrNow ("the Service," "the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Definitions

  • "Platform" refers to the JobrNow mobile application and all related services
  • "Worker" refers to individuals seeking hourly employment opportunities
  • "Employer" refers to businesses posting job opportunities
  • "User" refers to any person using the Platform (Workers, Employers, or Admins)
  • "Job" refers to a shift or employment opportunity posted by an Employer
  • "Application" refers to a Worker's submission to a Job posting
  • "Timesheet" refers to hours logged by a Worker for completed work

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to use JobrNow.

2.2 Legal Capacity

You must have the legal capacity to enter into binding contracts.

2.3 Geographic Restriction

JobrNow is currently available only in Canada. You must be located in Canada to use the Service.

2.4 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3. Account Registration and Security

3.1 Account Creation

  • You must create an account to use JobrNow
  • You may only create one account per person/business
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities under your account

3.2 Account Types

Worker Accounts:

  • Must provide valid skills and certificates
  • Must upload proof of certificates when required
  • Must maintain accurate availability information
  • Must connect a valid bank account for payouts

Employer Accounts:

  • Must provide valid business information
  • Must provide CRA business number
  • Must submit business verification documents
  • Must connect a valid payment method
  • Must be authorized to represent the business

3.3 Account Suspension

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Provide false information
  • Engage in fraudulent activity
  • Abuse or harass other users
  • Fail verification requirements

4. Platform Rules and Conduct

4.1 Prohibited Activities

You may not:

  • Use the Platform for any illegal purpose
  • Post false, misleading, or fraudulent job listings
  • Misrepresent your skills, certificates, or qualifications
  • Discriminate based on protected characteristics
  • Harass, threaten, or abuse other users
  • Attempt to circumvent the Platform's payment system
  • Share login credentials with others
  • Create multiple accounts
  • Use automated tools or bots
  • Scrape or collect user data
  • Reverse engineer the Platform
  • Upload malicious code or viruses

4.2 Content Standards

All content you post (job descriptions, profiles, messages) must:

  • Be accurate and truthful
  • Not violate any laws
  • Not infringe on intellectual property rights
  • Not contain offensive, discriminatory, or inappropriate material
  • Comply with Canadian employment laws

5. Worker-Specific Terms

5.1 Job Applications

  • Applications are binding expressions of interest
  • You may only apply to jobs you are qualified for
  • You must honor commitments to accepted jobs
  • Repeated no-shows may result in account suspension

5.2 Certificates and Skills

  • You must possess all certificates and skills you claim
  • You must upload valid proof of certificates when required
  • False claims may result in immediate account termination

5.3 Timesheets

  • You must accurately log hours worked
  • You must submit timesheets within Three days of shift completion
  • Fraudulent timesheets may result in account termination and legal action

5.4 Worker Classification

  • Workers are independent contractors, not employees of JobrNow
  • You are responsible for your own taxes and deductions
  • JobrNow does not provide employment benefits
  • You are not entitled to minimum wage, overtime, or other employment protections through JobrNow

5.5 Payments

  • Payments are processed weekly every Monday
  • Payment is contingent on Employer approval of timesheets
  • Disputed hours are held pending resolution
  • You must maintain a valid bank account connected via Stripe

6. Employer-Specific Terms

6.1 Job Postings

  • All job postings require admin approval before going live
  • Jobs expire after Thirty days if not filled
  • You must provide accurate job descriptions and requirements
  • You must comply with all employment laws
  • You may not discriminate in hiring decisions

6.2 Worker Selection

  • Worker names and photos are hidden until you select them (bias-free hiring)
  • Selection creates a binding commitment to the shift
  • Cancellations must be made 24 hours in advance or fees may apply

6.3 Timesheet Approval

  • You must review and respond to timesheets within 3 days
  • Approval triggers automatic payment processing
  • Disputes must include specific reasons and evidence
  • Repeated frivolous disputes may result in account suspension

6.4 Payments

  • You authorize JobrNow to charge your payment method for approved timesheets
  • Charges include worker pay plus platform fees
  • Failed payments may result in account suspension
  • You are responsible for all charges incurred under your account

6.5 Employer Classification

  • You are the employer of record for workers you hire
  • You are responsible for compliance with employment laws
  • You are responsible for workplace safety
  • JobrNow is a platform provider, not a staffing agency or employer

7. Platform Fees

7.1 Fee Structure

  • Platform Fee: 20% of the total job payment amount
  • Fees are charged to Employers upon approval of timesheets
  • Fees are subject to change with 7 days' notice

7.2 Payment Processing

  • All payments are processed through Stripe
  • Stripe fees may apply
  • JobrNow is not responsible for Stripe service issues

8. Dispute Resolution

8.1 Timesheet Disputes

  • Employers may dispute timesheets for legitimate reasons
  • Workers may respond with evidence
  • Admin makes final binding decision
  • Decisions are based on evidence provided

8.2 Platform Disputes

  • Users agree to first attempt to resolve disputes through our support team
  • If unresolved, disputes will be settled through binding arbitration in Ontario, Canada
  • Class action lawsuits are waived

9. Intellectual Property

9.1 Platform Ownership

JobrNow and all related trademarks, logos, and content are owned by JobrNow Inc. You may not use our intellectual property without permission.

9.2 User Content

  • You retain ownership of content you post
  • You grant JobrNow a worldwide, non-exclusive license to use, display, and distribute your content as necessary to provide the Service
  • You represent that you have rights to all content you post

10. Privacy and Data

Your use of JobrNow is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Guarantee of Results

  • We do not guarantee that Workers will find jobs
  • We do not guarantee that Employers will find suitable workers
  • We do not guarantee uninterrupted or error-free service

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBRNOW SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, revenue, or data
  • Damages exceeding the fees paid to JobrNow in the past 12 months
  • Actions or omissions of other users
  • Third-party service failures (Stripe, Firebase, etc.)

11.4 User Responsibility

  • You are responsible for your interactions with other users
  • You are responsible for verifying credentials and qualifications
  • You are responsible for workplace safety and compliance
  • JobrNow is not a party to agreements between Workers and Employers

12. Indemnification

You agree to indemnify and hold harmless JobrNow, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your violation of third-party rights
  • Content you post on the Platform

13. Termination

13.1 By You

You may terminate your account at any time through account settings or by contacting support.

13.2 By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent activity
  • Required by law
  • We cease operations

13.3 Effect of Termination

  • Your access to the Service will be revoked
  • Outstanding payments will be processed
  • Certain provisions (indemnification, limitations of liability) survive termination

14. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the app
  • Sending email notification
  • Displaying a prominent notice

Continued use after changes constitutes acceptance of the new Terms.

15. Modifications to Service

We reserve the right to:

  • Modify or discontinue features
  • Change fee structures (with notice)
  • Update platform requirements
  • Suspend service for maintenance

16. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobrNow regarding use of the Service.

19. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

20. Assignment

You may not assign or transfer these Terms. We may assign these Terms without restriction.
